Terms of Service

1. Parties
These Terms form a binding agreement between Fusengine Sàrl (CHE-144.098.128), Boulevard Saint-Martin 29, 1800 Vevey, Switzerland (the «Provider»), and the business entity subscribing to Bastion Security (the «Customer»). The Customer accepts these Terms by purchasing a subscription or by installing the extension on a production server.
2. Definitions
- Service: the Bastion Security Plesk extension and its supporting customer portal.
- Subscription: a paid, per-server license activated after the trial period.
- Plesk Node: a distinct installation of Plesk where the Service is deployed, identified by its cryptographic fingerprint.
3. Subscription, trial and billing
A 7-day trial requires a valid payment method at sign-up. No charge occurs during the trial. At trial end, the per-server subscription fee of CHF 19 per Plesk Node per month is billed automatically until the Customer cancels. Annual plans, where offered, are billed once and renew on the anniversary date. The auto-renewal terms, billing frequency, and the cancellation procedure are disclosed at point of purchase in compliance with LCD art. 3(1)(i) (transparency obligations under the Swiss Federal Act against Unfair Competition).
Prices are quoted excluding VAT and exclusive of any payment processor fees. Lemon Squeezy, Inc. acts as Merchant of Record (the «MoR») and is the Customer’s contractual counterpart for the payment transaction itself: it issues the invoice, collects and remits VAT/sales-tax, processes refunds and handles chargeback disputes. Billing-related claims must therefore be addressed to Lemon Squeezy under its own terms of service and refund policy. The Provider remains the sole licensor of the Service and the sole party to this agreement and to the EULA.
4. Cancellation and refunds
The Customer may cancel at any time through the customer portal. Cancellation stops further renewals but does not refund the current billing period. We refund within 14 days of an initial purchase only when the Service has not been used to enforce a decision on a production Plesk Node. Subsequent refund requests are governed by Lemon Squeezy’s published policy.
5. License grant
Provider grants the Customer a non-exclusive, non-transferable, non-sublicensable right to install and run the Service on the number of Plesk Nodes covered by the active Subscription. Any use beyond that scope, including resale, must be agreed in writing.
6. Acceptable use
The Customer agrees not to:
- resell, sublicense or redistribute the Service or its components;
- reverse-engineer, decompile or otherwise attempt to extract the source code of compiled artefacts (unless permitted by mandatory law);
- use the Service to attack, exfiltrate from or otherwise harm third parties;
- circumvent the per-server licensing model.
7. Support
Active subscribers receive email support during Swiss business days at support@bastion-security.io. Response targets are best-effort. A contractual Service Level Agreement may be negotiated under an Enterprise plan.
8. Updates
The Service receives regular updates through the Plesk Marketplace and the customer portal. Provider may add, modify or retire features. Significant changes are announced through the customer portal at least 30 days in advance.
9. Customer data and privacy
Processing of personal data is governed by the Privacy Policy. The Customer remains the controller of any personal data processed on its Plesk Nodes; Provider acts as processor for the limited diagnostic data described in the Privacy Policy.
10. Warranty disclaimer
The Service is provided «as is». Provider does not warrant that the Service will be uninterrupted, error-free or will detect every possible attack. The Customer remains responsible for its own security posture, backups, and incident response procedures.
11. Limitation of liability
To the maximum extent permitted by Swiss law (CO art. 100), Provider’s total aggregate liability under these Terms is capped at the amount paid by the Customer during the twelve (12) months preceding the event giving rise to the claim. Indirect, incidental, consequential or punitive damages, including loss of profits, loss of data and business interruption, are excluded.
Notwithstanding the foregoing, nothing in these Terms limits or excludes Provider’s liability for damages caused by willful misconduct (dol) or gross negligence (faute grave), as such limitation would be void under article 100(1) of the Swiss Code of Obligations.
12. Term and termination
These Terms remain in force as long as the Subscription is active. Provider may suspend or terminate the Service for unpaid invoices, breach of these Terms, or sustained abusive use, after a 14-day cure notice except in cases of material breach where immediate termination is justified.
Sections 5 (License grant restrictions for past period), 6 (Acceptable use, where applicable), 9 (Customer data and privacy), 10 (Warranty disclaimer), 11 (Limitation of liability) and 14 (Governing law and jurisdiction) survive termination of these Terms.
13. Modifications
Provider may amend these Terms. Material changes take effect 30 days after publication. Continued use of the Service after the effective date constitutes acceptance.
14. Governing law and jurisdiction
These Terms are governed by Swiss substantive law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. Exclusive jurisdiction lies with the ordinary courts of the canton of Vaud, Switzerland (CPC art. 10), subject to mandatory consumer protection rules.
